Tous ceux d\u2019entre vous qui font partie d\u2019un syndicat de copropri\u00e9t\u00e9, doivent savoir que gr\u00e2ce \u00e0 la Loi 8\/2013 (du 26 juin) r\u00e9cemment approuv\u00e9e, la Loi 49\/1960 de Copropri\u00e9t\u00e9 a \u00e9t\u00e9 modifi\u00e9e.<\/p>\n

Bien que de nombreux articles ont chang\u00e9, et en particulier ceux qui font r\u00e9f\u00e9rence au r\u00e9gime de majorit\u00e9s n\u00e9cessaires pour adopter les diff\u00e9rents types d\u2019accords au sein d\u2019un syndicat de copropri\u00e9t\u00e9, nous allons quant \u00e0 nous nous concentrer sur cet article, sur les nouveaut\u00e9s relatives \u00e0 la r\u00e9clamation de dettes aux propri\u00e9taires mauvais payeurs de mensualit\u00e9s impay\u00e9es. Dans ce sens, il faut souligner :<\/p>\n

<\/p>\n

1.- A partir de maintenant, la personne ou soci\u00e9t\u00e9 qui acquerra une propri\u00e9t\u00e9 r\u00e9pondra du bien immobilier acquis, des montants dus par les propri\u00e9taires pr\u00e9c\u00e9dents, relatifs \u00e0 l\u2019ann\u00e9e d\u2019acquisition et aux trois ann\u00e9es civiles pr\u00e9c\u00e9dentes.<\/b> Ceci est un changement important car avant, on r\u00e9pondait uniquement de l\u2019ann\u00e9e d\u2019achat et de l\u2019ann\u00e9e pr\u00e9c\u00e9dente, c\u2019est-\u00e0-dire un maximum de 2 ans. Maintenant le nouveau propri\u00e9taire sera responsable pour un maximum de 4 ans.<\/p>\n

Cela signifie qu\u2019avant l\u2019achat d\u2019un bien immobilier, il est fondamental d\u2019obtenir un certificat de dette de la copropri\u00e9t\u00e9 qui soit r\u00e9alis\u00e9 selon toutes les formalit\u00e9s marqu\u00e9es par la loi. Afin de nous assurer que l\u2019on ne peut pas nous r\u00e9clamer cette dette, qui peut \u00eatre tr\u00e8s \u00e9lev\u00e9e. <\/span><\/p>\n

2.- A partir de maintenant, les cr\u00e9dits pour les dettes en faveur de la copropri\u00e9t\u00e9, de l\u2019annualit\u00e9 en cours et des trois ann\u00e9es pr\u00e9c\u00e9dentes, sont consid\u00e9r\u00e9s comme pr\u00e9f\u00e9rentiels, selon l\u2019article 1923 du Code Civil.<\/b><\/p>\n

Ceci est un changement fondamental, car la dette de la copropri\u00e9t\u00e9 aura m\u00eame la priorit\u00e9 sur les pr\u00eats hypoth\u00e9caires qui gr\u00e8vent la propri\u00e9t\u00e9.<\/p>\n

CONCLUSION, avec ce changement r\u00e9glementaire, les droits des syndicats de copropri\u00e9taires sont am\u00e9lior\u00e9s concernant l\u2019encaissement des mensualit\u00e9s impay\u00e9es de fa\u00e7on importante. En effet on leur attribue un caract\u00e8re pr\u00e9f\u00e9rentiel, et l\u2019on oblige les acqu\u00e9reurs (acheteurs, banques qui s\u2019attribuent des biens immobiliers hypoth\u00e9qu\u00e9s, etc.) \u00e0 prendre en charge les dettes accumul\u00e9es d\u2019un d\u00e9lai sup\u00e9rieur au pr\u00e9c\u00e9dent.<\/p>\n
