Attention aux recours \u00abgratuits\u00bb ou \u00abNo Win No Fees\u00bb."},"content":{"rendered":"<p style=\"text-align: justify;\">Chers lecteurs,<\/p>\n<p style=\"text-align: justify;\">Dans notre article d&rsquo;aujourd&rsquo;hui nous aimerions vous avertir d&rsquo;un certain manque d&rsquo;information ou d&rsquo;information erron&eacute;e que des entreprises ou professionnels donnent aux personnes affect&eacute;es par les clauses sol, relatives aux recours connus comme les &laquo;no win no fees&raquo; &laquo;gratuits&raquo; ou &laquo;si vous ne touchez rien nous ne vous prenons rien&raquo;.<\/p>\n<p style=\"text-align: justify;\">Certains professionnels proposent aux personnes touch&eacute;es par les clauses sol de recourir en leur nom contre les &eacute;tablissements bancaires et devant les tribunaux, en indiquant qu&rsquo;ils toucheront leurs honoraires uniquement si les demandes sont estim&eacute;es. Nous entendons que cela peut &ecirc;tre positif pour les personnes affect&eacute;es, et d&rsquo;ailleurs notre cabinet offre &eacute;galement ce service.<\/p>\n<p style=\"text-align: justify;\">Mais dans ces cas-l&agrave;, il est &eacute;galement important d&rsquo;informer les clients que m&ecirc;me s&rsquo;il est vrai que les probabilit&eacute;s de succ&egrave;s sont tr&egrave;s &eacute;lev&eacute;es, d&rsquo;ailleurs notre cabinet a recouru avec succ&egrave;s dans 100% des cas, l&eacute;galement on doit informer les clients que potentiellement, dans le cas improbable bien que possible cas o&ugrave; la proc&eacute;dure judiciaire serait perdue, ils pourraient &ecirc;tre condamn&eacute;s par le tribunal &agrave; payer les frais de justice de la proc&eacute;dure, c&rsquo;est-&agrave;-dire &agrave; payer les frais de l&rsquo;avocat et du procureur de la banque, comme le dit l&rsquo;article 394.1 de la Loi de Proc&eacute;dure Civile, qui indique<\/p>\n<p style=\"text-align: justify;\"><em>&laquo;Lors des proc&eacute;dures d&eacute;claratoires, les frais de la premi&egrave;re instance seront impos&eacute;s &agrave; la partie dont toutes les demandes auront &eacute;t&eacute; rejet&eacute;es, sauf si le tribunal trouve, et d&eacute;clare ainsi, que le cas pr&eacute;sentait de s&eacute;rieux doutes de fait ou de droit&raquo;.<\/em><\/p>\n<p style=\"text-align: justify;\">En ce sens, nous voulons signaler qu&rsquo;il existe des strat&eacute;gies l&eacute;gales pour minimiser le risque de perdre la proc&eacute;dure judiciaire et d&rsquo;&ecirc;tre condamn&eacute; &agrave; payer les frais, par exemple si en plus de recourir pour les clauses sol, on r&eacute;clame dans la m&ecirc;me demande pour la nullit&eacute; d&rsquo;autres clauses qui sont clairement abusives, et qui apparaissent dans de nombreux pr&ecirc;ts hypoth&eacute;caires, comme par exemple&nbsp;:<\/p>\n<p style=\"text-align: justify;\"><strong>.- Int&eacute;r&ecirc;ts de retard abusifs. <\/strong>Actuellement un int&eacute;r&ecirc;t moratoire sup&eacute;rieur au triple de l&rsquo;int&eacute;r&ecirc;t l&eacute;gal de l&rsquo;argent, est consid&eacute;r&eacute; comme abusif. Pour l&rsquo;ann&eacute;e 2016, l&rsquo;int&eacute;r&ecirc;t l&eacute;gal est de 3%, par cons&eacute;quent si vous avez un int&eacute;r&ecirc;t de retard sup&eacute;rieur &agrave; 9%, vous pouvez r&eacute;clamer sa nullit&eacute;.<\/p>\n<p style=\"text-align: justify;\">.- De la m&ecirc;me mani&egrave;re, vous pouvez demander la nullit&eacute; d&rsquo;autres clauses, comme celles connues comme <strong><em>&laquo;&eacute;ch&eacute;ance anticip&eacute;e du pr&ecirc;t&raquo;<\/em><\/strong>, &agrave; travers lesquelles la banque se r&eacute;serve le droit de r&eacute;silier le pr&ecirc;t hypoth&eacute;caire et demander le remboursement de tout le capital restant d&ucirc;, pour un simple retard dans le paiement de l&rsquo;une des mensualit&eacute;s. Ce type de clauses sont abusives parce qu&rsquo;elles ne sont pas proportionnelles, et ne tiennent pas non plus compte de la gravit&eacute; du manquement, ni permet au consommateur de le r&eacute;soudre, etc.<\/p>\n<p style=\"text-align: justify;\">Par cons&eacute;quent, il est conseill&eacute; de demander en plus de la nullit&eacute; de la clause sol, la nullit&eacute; d&rsquo;autres clauses abusives que comporte le pr&ecirc;t hypoth&eacute;caire, parce que comme &ccedil;a les possibilit&eacute;s de perdre compl&egrave;tement la proc&eacute;dure&nbsp; et d&rsquo;&ecirc;tre condamn&eacute;s &agrave; payer les frais des avocats de la banque seront extr&ecirc;mement faibles.
