Condition de Terrain."},"content":{"rendered":"<p style=\"text-align: justify;\">Dans de nombreux articles nous avons rappel&eacute; &agrave; nos lecteurs qui veulent acheter une propri&eacute;t&eacute; en Espagne, le besoin de r&eacute;aliser une &laquo;due diligence&raquo; de la propri&eacute;t&eacute; qu&rsquo;ils souhaitent acqu&eacute;rir, car l&rsquo;achat d&rsquo;un bien immobilier implique normalement un investissement tr&egrave;s important et il est fondamental de prendre toutes les pr&eacute;cautions possibles afin d&rsquo;&eacute;viter des probl&egrave;mes, qui dans certains cas peuvent avoir des cons&eacute;quences tr&egrave;s n&eacute;gatives.<\/p>\n<p style=\"text-align: justify;\">L&rsquo;un des probl&egrave;mes courants est qu&rsquo;il existe de nombreuses propri&eacute;t&eacute;s qui sont inscrites correctement au registre de la propri&eacute;t&eacute; et au cadastre, qui sont consid&eacute;r&eacute;es comme urbaines, qui ont un permis d&rsquo;habitabilit&eacute;, l&rsquo;approvisionnement en eau et &eacute;lectricit&eacute; d&eacute;finitifs, etc., et qui par cons&eacute;quent ont une apparence correcte. Mais certaines de ces propri&eacute;t&eacute;s se trouvent sur un sol urbain non consolid&eacute; et n&rsquo;ont pas la condition l&eacute;gale de terrain, par cons&eacute;quent les travaux d&rsquo;urbanisation de la zone ne sont pas achev&eacute;s (elles ne sont pas d&ucirc;ment urbanis&eacute;es), ce qui veut dire que si leurs propri&eacute;taires veulent par exemple r&eacute;aliser des travaux, ils devront compl&eacute;ter les travaux d&rsquo;urbanisation, et parfois on les obligera &agrave; faire les trottoirs, l&rsquo;&eacute;clairage public, etc. D&rsquo;autres fois cela peut &ecirc;tre tr&egrave;s compliqu&eacute; ou co&ucirc;teux de faire ces travaux, selon les circonstances du cas.<\/p>\n<p style=\"text-align: justify;\">Les r&eacute;gions autonomes en Espagne ont leur propre r&eacute;glementation, par exemple dans la Comunidad Valenciana (R&eacute;gion Valencienne), actuellement la Loi 5\/2014 d&rsquo;Am&eacute;nagement du Territoire, Urbanisme et paysage de la &laquo;Comunitat Valenciana&raquo; est en vigueur, qui par exemple dans son article 177 et en relation avec les propri&eacute;t&eacute;s qui sont l&eacute;galement consid&eacute;r&eacute;es comme des terrains, signale&nbsp;:<\/p>\n<p style=\"text-align: justify;\">.- Que les terrains sont des parcelles l&eacute;galement divis&eacute;es, urbanis&eacute;es selon des r&eacute;glementations techniques, etc.<\/p>\n<p style=\"text-align: justify;\">.- En outre il y est dit qu&rsquo;elles devront avoir&nbsp;:<\/p>\n<p>Acc&egrave;s roulant jusqu&rsquo;&agrave; ces derni&egrave;res par voie pav&eacute;e.<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;.-Approvisionnement d&rsquo;eau potable et d&rsquo;&eacute;nergie &eacute;lectrique, avec les d&eacute;bits et la puissance suffisante pour la construction pr&eacute;vue.<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; .-Evacuation des eaux us&eacute;es au r&eacute;seau d&rsquo;&eacute;gouts connect&eacute; &agrave; la station d&rsquo;&eacute;puration des eaux us&eacute;es.<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; .-Acc&egrave;s pi&eacute;ton, trottoirs et &eacute;clairage public dans, au moins, l&rsquo;une des voies qui sera face &agrave; la parcelle.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">Par cons&eacute;quent, bien qu&rsquo;habituellement &ccedil;a ne se fait pas de la part des agents immobiliers, conseillers, et que ce n&rsquo;est pas au notaire de le faire, il est fondamental de v&eacute;rifier si la propri&eacute;t&eacute; que vous &ecirc;tes en train d&rsquo;acheter ou souhaitez acheter en Espagne poss&egrave;de ou non la condition l&eacute;gale de terrain et si elle est urbanis&eacute;e.
