La Condition R\u00e9solutoire en droit espagnol."},"content":{"rendered":"<p style=\"text-align: justify;\">Nous recevons parfois des consultations d&rsquo;acheteurs et de vendeurs qui, bien qu&rsquo;ils soient d&rsquo;accord avec les conditions d&rsquo;achat-vente, ne peuvent pas payer la totalit&eacute; du prix et ont des probl&egrave;mes pour obtenir un financement, normalement un pr&ecirc;t hypoth&eacute;caire qui leur permet d&rsquo;acqu&eacute;rir la propri&eacute;t&eacute; de la fa&ccedil;on habituelle.<\/p>\n<p style=\"text-align: justify;\">Ainsi, l&rsquo;acheteur a besoin de reporter une partie du prix car il ne dispose pas de l&rsquo;argent, et le vendeur a besoin de garanties pour pouvoir r&eacute;cup&eacute;rer la propri&eacute;t&eacute; si on ne lui paie pas la totalit&eacute; du prix accord&eacute;. Dans ces circonstances il existe une solution qui consiste &agrave; garantir le paiement d&ucirc; au moyen d&rsquo;une condition r&eacute;solutoire, en pr&eacute;cisant que l&rsquo;acheteur reporte le paiement d&rsquo;une partie du prix, et qu&rsquo;en cas de ne pas payer selon ce qui a &eacute;t&eacute; accord&eacute;, l&rsquo;achat-vente sera finalis&eacute;, et le vendeur pourra r&eacute;cup&eacute;rer le bien vendu.<\/p>\n<p style=\"text-align: justify;\">Ainsi, la principale fonction de la condition r&eacute;solutoire est celle de garantir, d&rsquo;un c&ocirc;t&eacute;, que l&rsquo;acheteur peut b&eacute;n&eacute;ficier de la possession et l&rsquo;usage de la propri&eacute;t&eacute; m&ecirc;me s&rsquo;il n&rsquo;a pas pay&eacute; tout le prix, et d&rsquo;un autre c&ocirc;t&eacute;, que le vendeur dans le cas o&ugrave; il ne s&rsquo;en tient pas aux paiements accord&eacute;s, ils pourront r&eacute;cup&eacute;rer la propri&eacute;t&eacute;.<\/p>\n<p style=\"text-align: justify;\">Dans le code civil espagnol, la condition r&eacute;solutoire dans le cas de la vente de biens immobiliers, a une particularit&eacute;, selon l&rsquo;article 1504 du Code Civil&nbsp;:<\/p>\n<p style=\"text-align: justify;\"><em>&hellip; m&ecirc;me lorsqu&rsquo;il aura &eacute;t&eacute; stipul&eacute; que pour d&eacute;faut de paiement du prix en temps convenu, la finalisation du contrat aura lieu de plein droit, l&rsquo;acheteur pourra payer, m&ecirc;me apr&egrave;s le d&eacute;lai expir&eacute;, &agrave; condition qu&rsquo;entre-temps il n&rsquo;ait pas &eacute;t&eacute; mis en demeure judiciairement ou par acte notari&eacute;.
