Normalement cela arrive avec les biens immobiliers en co-propri&eacute;t&eacute;, dont plusieurs personnes sont propri&eacute;taires de logements, locaux commerciaux, etc. apr&egrave;s un h&eacute;ritage, un divorce, une s&eacute;paration, etc. et la relation entre eux n&rsquo;est pas celle qui serait souhaitable.<\/p>\n<p style=\"text-align: justify;\">Souvent il se trouve que l&rsquo;un des propri&eacute;taires refuse de permettre l&rsquo;usage du bien immobilier aux autres, et il l&rsquo;utilise de mani&egrave;re exclusive.<\/p>\n<p style=\"text-align: justify;\">Nous avons d&eacute;j&agrave; vu dans des articles pr&eacute;c&eacute;dents que l&eacute;galement il existe la&nbsp; possibilit&eacute; de forcer la vente du bien immobilier (chose commune) conform&eacute;ment au droit espagnol, s&rsquo;il n&rsquo;est pas possible de parvenir &agrave; un accord entre les copropri&eacute;taires.<\/p>\n<p style=\"text-align: justify;\">Dans l&rsquo;article d&rsquo;aujourd&rsquo;hui nous allons analyser ce que peut faire un propri&eacute;taire si l&rsquo;on ne le laisse pas utiliser la propri&eacute;t&eacute; commune ou le bien immobilier en copropri&eacute;t&eacute;.<\/p>\n<p style=\"text-align: justify;\">Lorsque quelqu&rsquo;un est propri&eacute;taire d&rsquo;un bien immobilier avec d&rsquo;autres personnes, ils forment un syndicat de copropri&eacute;t&eacute;, et conform&eacute;ment au code civil espagnol, et plus concr&egrave;tement &agrave; l&rsquo;article 394, chaque propri&eacute;taire a le droit d&rsquo;utiliser la chose commune, devant permettre aux autres de l&rsquo;utiliser &eacute;galement, selon le droit qu&rsquo;ils poss&egrave;dent, ainsi cet article dit&nbsp;:<\/p>\n<p style=\"text-align: justify;\"><em>Chaque usager pourra se servir des choses communes, &agrave; condition d&rsquo;en disposer selon sa destination et de fa&ccedil;on &agrave; ne pas nuire &agrave; l&rsquo;int&eacute;r&ecirc;t de la copropri&eacute;t&eacute;, ni emp&ecirc;cher les autres co-usagers de les utiliser conform&eacute;ment &agrave; leur droit.<\/em><\/p>\n<p style=\"text-align: justify;\">Par cons&eacute;quent, si un bien immobilier appartient &agrave; 3 personnes et que chacune d&rsquo;elles est propri&eacute;taire de 33,33%, si l&rsquo;une d&rsquo;elles utilisait exclusivement le bien immobilier sans laisser les autres en faire usage selon leur droit et % de propri&eacute;t&eacute;, ces derniers pourront r&eacute;clamer contre elle, pour les principes&nbsp;suivants&nbsp;:<\/p>\n<p style=\"text-align: justify;\">.- Que l&rsquo;on lui permette d&rsquo;utiliser la propri&eacute;t&eacute; conform&eacute;ment &agrave; son % de propri&eacute;t&eacute;, normalement par un syst&egrave;me de tours.<\/p>\n<p style=\"text-align: justify;\">.- Si le copropri&eacute;taire refuse on pourra r&eacute;clamer un d&eacute;dommagement &eacute;conomique pour le non-respect de l&rsquo;article 394 CC signal&eacute;, car on emp&ecirc;che les copropri&eacute;taires d&rsquo;utiliser le bien immobilier selon son droit.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">Il est fondamental dans ces cas-l&agrave; de demander de fa&ccedil;on formelle au propri&eacute;taire qu&rsquo;il permette l&rsquo;usage du bien immobilier aux autres, et ne puisse pas all&eacute;guer par la suite qu&rsquo;il a &eacute;t&eacute; permis par les autres que lui seul utilise le bien immobilier.<\/p>\n<p style=\"text-align: justify;\">Si l&rsquo;on souhaite demander un d&eacute;dommagement &eacute;conomique il faudra &eacute;galement d&eacute;montrer la rentabilit&eacute; du march&eacute; qui correspond au bail du bien immobilier, avec un rapport d&rsquo;expertise, la certification de plusieurs agents immobiliers qui connaissent la r&eacute;gion et le march&eacute;, etc., aux effets le cas &eacute;ch&eacute;ant de pouvoir quantifier le montant &agrave; r&eacute;clamer.<\/p>\n<p style=\"text-align: justify;\">Par cons&eacute;quent, si vous &ecirc;tes copropri&eacute;taire d&rsquo;un ou de plusieurs biens immobiliers en Espagne, avec un ou plusieurs propri&eacute;taires, et si vous ne parvenez pas &agrave; un accord pour l&rsquo;usage du bien immobilier, ou simplement on ne vous permet pas de l&rsquo;utiliser, sachez que l&eacute;galement vous avez le droit d&rsquo;utiliser la propri&eacute;t&eacute; de fa&ccedil;on proportionnelle &agrave;
