L\u2019importance du certificat d\u2019habitabilit\u00e9."},"content":{"rendered":"<p style=\"text-align: justify;\"><em>Consultation: Cher avocat, je vais acheter une propri&eacute;t&eacute; &agrave; Denia (Costa Blanca), et j&rsquo;ai trouv&eacute; des avis mitig&eacute;s sur l&rsquo;importance que la propri&eacute;t&eacute; ait ou pas un certificat d&rsquo;habitabilit&eacute;. Le vendeur me dit que la propri&eacute;t&eacute; a les contrats de distribution d&rsquo;eau et d&rsquo;&eacute;lectricit&eacute;, que ce certificat n&rsquo;est pas n&eacute;cessaire, qu&rsquo;il n&rsquo;y a aucun probl&egrave;me si elle n&rsquo;en a pas et qu&rsquo;apparemment elle n&rsquo;en a jamais eu. Merci de bien vouloir me fournir votre conseil juridique &agrave; ce propos.<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>&nbsp;<\/strong><\/p>\n<p style=\"text-align: justify;\">Cher client, nous vous remercions de nous avoir adress&eacute; votre demande.<\/p>\n<p style=\"text-align: justify;\">&Agrave; la Communaut&eacute; Valencienne, le certificat d&rsquo;habitabilit&eacute; est r&eacute;glement&eacute; dans la Loi 5\/2014 du 25 juillet sur l&rsquo;am&eacute;nagement du territoire, l&rsquo;urbanisme et le paysage, (la LOTUP en espagnol) et dans la Loi 3\/2004 du 30 juin, sur l&rsquo;am&eacute;nagement et la promotion de la qualit&eacute; des b&acirc;timents (la LOFCE en espagnol).<\/p>\n<p style=\"text-align: justify;\">Selon la LOFCE, le certificat d&rsquo;habitabilit&eacute; est une autorisation municipale et doit donc &ecirc;tre d&eacute;cern&eacute; par la mairie o&ugrave; se trouve la propri&eacute;t&eacute; concern&eacute;e et, selon les articles 32 et suivants, c&rsquo;est une autorisation <strong>&nbsp;qui reconna&icirc;t et prot&egrave;ge l&rsquo;aptitude &agrave; l&rsquo;usage des b&acirc;timents. <\/strong>Par cons&eacute;quent, c&rsquo;est l&rsquo;autorisation qui nous permet d&rsquo;occuper l&eacute;galement &nbsp;la propri&eacute;t&eacute; consid&eacute;r&eacute;e comme logement et aussi de pouvoir signer les contrats de distribution d&rsquo;eau, d&rsquo;&eacute;lectricit&eacute;, etc. &agrave; cette fin. Par ailleurs il faut savoir que, suite &agrave; son obtention initiale, cette autorisation doit &ecirc;tre renouveler tous les 10 ans s&rsquo;il y a transmission du bien (vente), et aussi dans d&rsquo;autres cas pr&eacute;vus dans la norme.<\/p>\n<p style=\"text-align: justify;\">De son c&ocirc;t&eacute;, la LOTUP,&nbsp; qui est post&eacute;rieure, stipule que la propri&eacute;t&eacute; <strong>est soumise &agrave; une d&eacute;claration responsable. <\/strong>Donc, en principe, le certificat d&rsquo;habitabilit&eacute; en tant que tel ne serait plus n&eacute;cessaire, il suffirait de pr&eacute;senter une d&eacute;claration accompagn&eacute;e d&rsquo;une s&eacute;rie de documents pr&eacute;vus dans la r&eacute;glementation et cela &eacute;quivaudrait au certificat d&rsquo;habitabilit&eacute;.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">Mais, bien que cette r&eacute;glementation semble meilleure, <strong>nous estimons que cela ajoute une ins&eacute;curit&eacute; juridique importante par rapport &agrave; un document qui est essentiel,<\/strong><\/span> <strong>&nbsp;<\/strong>car il est possible d&rsquo;avoir pr&eacute;sent&eacute; une d&eacute;claration responsable avec la documentation, mais d&eacute;couvrir par la suite que cela n&rsquo;est pas suffisant, car soit la documentation n&rsquo;est pas correcte, soit la propri&eacute;t&eacute; n&rsquo;est pas conforme &agrave; la r&eacute;glementation,&nbsp;etc. Dans ce cas, la mairie peut signaler <em>a posteriori<\/em> que la d&eacute;claration responsable n&rsquo;est pas correcte et donc la propri&eacute;t&eacute; n&rsquo;est pas susceptible d&rsquo;&ecirc;tre occup&eacute;e et la d&eacute;claration responsable n&rsquo;a plus de valeur.<\/p>\n<p style=\"text-align: justify;\">La jurisprudence espagnole a soulign&eacute; &agrave; maintes reprises l&rsquo;importance du certificat d&rsquo;habitabilit&eacute;, car c&rsquo;est l&rsquo;autorisation qui reconna&icirc;t et permet l&rsquo;usage d&rsquo;une construction, dans ce cas comme logement, de telle sorte que, ne pas l&rsquo;avoir veut dire qu&rsquo;en principe celle-ci ne peut pas &ecirc;tre occup&eacute;e, ni &ecirc;tre utilis&eacute;e comme logement, qu&rsquo;elle ne peut pas &ecirc;tre approvisionn&eacute;e en eau, &eacute;lectricit&eacute;, etc. Ainsi, la loi espagnole sous-entend qu&rsquo;un promoteur ne livre ni l&eacute;galement ni correctement un logement sans certificat d&rsquo;habitabilit&eacute;, celui-ci ayant un caract&egrave;re essentiel.<\/p>\n<p style=\"text-align: justify;\">L&rsquo;absence de ce permis peut aussi avoir d&rsquo;autres cons&eacute;quences: ne pas pouvoir, par exemple, affecter le logement &agrave; la location touristique.<\/p>\n<p style=\"text-align: justify;\">Ainsi, si nous allons acheter une propri&eacute;t&eacute;,&nbsp; il est tr&egrave;s important de v&eacute;rifier si dans le pass&eacute; elle a obtenu ce permis d&rsquo;occupation \/ certificat d&rsquo;habitabilit&eacute; et si elle en avait un, s&rsquo;il a &eacute;t&eacute; renouvel&eacute; ou bien s&rsquo;il peut l&rsquo;&ecirc;tre, etc.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">Si vous souhaitez acheter une propri&eacute;t&eacute; en toute s&eacute;curit&eacute; juridique, et vous souhaitez v&eacute;rifier si le bien est conforme &agrave; la r&eacute;glementation en vigueur en mati&egrave;re de certificat d&rsquo;habitabilit&eacute;, etc. <strong>&nbsp;Contactez-nous, nous pouvons vous aider.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">L&rsquo;information fournie dans cet article ne vise pas &agrave; donner des conseils l&eacute;gaux, mais simplement &agrave; transmettre des renseignements li&eacute;s &agrave; des questions juridiques.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">Carlos Baos (Avocat)<\/p>\n<p style=\"text-align: justify;\">White &amp; Baos Avocats<\/p>\n<p style=\"text-align: justify;\">T&eacute;l. : +34 96 642 61 85<\/p>\n<p style=\"text-align: justify;\">e-mail : <a href=\"mailto:info@white-baos.com\">info@white-baos.com<\/a><\/p>\n<p style=\"text-align: justify;\">White &amp; Baos 2019&ndash; Tous droits r&eacute;serv&eacute;s<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Consultation: Cher avocat, je vais acheter une propri&eacute;t&eacute; &agrave; Denia (Costa Blanca), et j&rsquo;ai trouv&eacute; des avis mitig&eacute;s sur l&rsquo;importance que la propri&eacute;t&eacute; ait ou pas un certificat d&rsquo;habitabilit&eacute;.
