Il m&rsquo;informe &agrave; pr&eacute;sent qu&rsquo;il a trouv&eacute; un acheteur, mais je lui ai fait savoir que je ne voulais plus vendre &agrave; ce prix. Il me dit que je dois lui verser ses honoraires m&ecirc;me si je refuse de vendre. Est-ce vrai?<\/em><\/p>\n<p style=\"text-align: justify;\"><em>&nbsp;<\/em><\/p>\n<p style=\"text-align: justify;\">Cher lecteur, nous vous remercions de nous avoir adress&eacute; votre demande.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">En premier lieu, nous vous signalons que pour pouvoir mieux vous r&eacute;pondre nous devrions &eacute;tudier le contrat que vous avez sign&eacute; avec l&rsquo;agent immobilier.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">De toute mani&egrave;re, et de fa&ccedil;on g&eacute;n&eacute;rale, sans que cela repr&eacute;sente un conseil juridique sp&eacute;cifique &agrave; votre cas, &nbsp;nous pouvons vous informer que:<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">.-Les contrats que l&rsquo;on signe normalement avec les agents immobiliers, pour qu&rsquo;ils aident &agrave; la vente de biens immobiliers, sont consid&eacute;r&eacute;s dans le droit espagnol comme des contrats de m&eacute;diation.<\/p>\n<p style=\"text-align: justify;\">.-De par ces contrats, l&rsquo;agent immobilier a l&rsquo;obligation de chercher et de trouver de possibles acheteurs qui soient pr&ecirc;ts &agrave; acheter la propri&eacute;t&eacute;&nbsp; selon les conditions d&eacute;termin&eacute;es par le vendeur.<\/p>\n<p style=\"text-align: justify;\">.-Sauf convention contraire, le droit de l&rsquo;agent &agrave; percevoir des honoraires ne d&eacute;pend pas du fait que son travail aboutisse &agrave; l&rsquo;acte de vente, mais du fait qu&rsquo;il a contribu&eacute; &agrave; la signature de cet acte de vente, m&ecirc;me si pour finir cela n&rsquo;a pas eu lieu.<\/p>\n<p style=\"text-align: justify;\">.-Ainsi, si la seule raison pour laquelle le contrat d&rsquo;achat entre l&rsquo;acheteur et vous-m&ecirc;me n&rsquo;a pas abouti, est que vous refusez de vendre dans les conditions pr&eacute;c&eacute;demment convenues avec l&rsquo;agent, si celui-ci r&eacute;clamait judiciairement contre vous, les tribunaux espagnols pourraient dicter que l&rsquo;agent a accompli son labeur de m&eacute;diation en trouvant un acheteur dispos&eacute; &agrave; acheter la propri&eacute;t&eacute; selon vos propres instructions, et qu&rsquo;il a donc le droit de toucher ses prestations, sans que votre refus de vente, donc la non-signature du contrat de vente entre acheteur et vendeur, ne puisse emp&ecirc;cher que les honoraires soient acquis et puissent &ecirc;tre r&eacute;clam&eacute;s.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">Les tribunaux espagnols se sont prononc&eacute;s dans ce sens dans divers jugements, comme celui du 20\/12\/2018 de la Cour Provinciale de S&eacute;ville, qui confirme ce raisonnement en signalant que:<\/p>\n<p style=\"text-align: justify;\"><em>&nbsp;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>&ldquo;L&rsquo;agent aurait &eacute;galement droit &agrave; la somme qu&rsquo;il r&eacute;clame, car,&nbsp; comme indiqu&eacute; dans la demande et comme il a &eacute;t&eacute; pleinement d&eacute;montr&eacute;,&nbsp; il a ex&eacute;cut&eacute; la t&acirc;che confi&eacute;e et que si l&rsquo;acte de vente n&rsquo;est pas finalis&eacute; c&rsquo;est uniquement d&ucirc; &agrave; la d&eacute;cision unilat&eacute;rale des d&eacute;fendeurs&rdquo;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>&nbsp;<\/em><\/p>\n<p style=\"text-align: justify;\">Ainsi, si vous &ecirc;tes agent immobilier o si vous poss&eacute;dez une propri&eacute;t&eacute; en Espagne que vous souhaitez vendre, sachez qu&rsquo;il est essentiel de n&eacute;gocier correctement les contrats entre vendeur et agent, et que certains &eacute;l&eacute;ments doivent &ecirc;tre clairement d&eacute;crits: indiquer si&nbsp;
