Proc\u00e9dure. \u00c9tapes \u00e0 suivre."},"content":{"rendered":"<p style=\"text-align: justify;\">Si nous souhaitons transmettre une partie d&rsquo;une propri&eacute;t&eacute;, soit pour la vendre, soit pour en faire un don, etc., la division de terrains peut s&rsquo;av&eacute;rer une op&eacute;ration tr&egrave;s utile.<\/p>\n<p style=\"text-align: justify;\">Il s&rsquo;agit de s&eacute;parer une partie de l&rsquo;ensemble de la propri&eacute;t&eacute; d&rsquo;origine, qui devient ainsi une nouvelle propri&eacute;t&eacute; fonci&egrave;re ind&eacute;pendante et qui peut &ecirc;tre transmise par elle-m&ecirc;me.<\/p>\n<p style=\"text-align: justify;\">Un exemple typique de ce genre d&rsquo;op&eacute;rations est celui de parents &nbsp;propri&eacute;taires d&rsquo;un vaste terrain qui souhaitent en donner une partie &agrave; un enfant&nbsp; pour la construction d&rsquo;une maison. De par cette op&eacute;ration, les parents pourraient s&eacute;parer une parcelle de la propri&eacute;t&eacute; pour la convertir en un bien foncier ind&eacute;pendant et pouvoir ainsi donner uniquement cette partie &agrave; l&rsquo;enfant sans que le reste de la propri&eacute;t&eacute; ne soit affect&eacute;e.<\/p>\n<p style=\"text-align: justify;\">Un autre cas assez fr&eacute;quent est celui de quelqu&rsquo;un qui souhaite agrandir son terrain ou sa propri&eacute;t&eacute; pour y construire une piscine, par exemple, en achetant une partie du terrain du voisin adjacent. Pour pouvoir r&eacute;aliser cette op&eacute;ration, le voisin vendeur devrait proc&eacute;der &agrave; une division de la partie du terrain qui int&eacute;resse l&rsquo;acheteur, afin de la convertir en un terrain ind&eacute;pendant avant sa vente.<\/p>\n<p style=\"text-align: justify;\">Cette op&eacute;ration, qui peut sembler assez simple, n&eacute;cessite dans la pratique d&rsquo;effectuer certaines d&eacute;marches l&eacute;gales et administratives qui sont obligatoires si l&rsquo;on veut bien s&rsquo;y prendre.<\/p>\n<p style=\"text-align: justify;\">Tout d&rsquo;abord, il faut contacter un expert, g&eacute;n&eacute;ralement un architecte, qui dressera un rapport du projet de division o&ugrave; il aura r&eacute;alis&eacute; les mesures et les calculs appropri&eacute;s, en d&eacute;crivant dans le d&eacute;tail les caract&eacute;ristiques de la nouvelle propri&eacute;t&eacute; d&eacute;tach&eacute;e &agrave; partir de la division, et celles de la propri&eacute;t&eacute; d&rsquo;origine restant, suite &agrave; la division.<\/p>\n<p style=\"text-align: justify;\">&Agrave; continuation, une fois le rapport &eacute;tabli, il faut demander (normalement) un permis de division &agrave; la mairie.
