Il est &eacute;vident que la plus connue est la transmission de la propri&eacute;t&eacute; ou <em>traditio<\/em>, par un acte de vente, de donation, etc.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">Le pr&eacute;sent article aborde une autre fa&ccedil;on d&rsquo;acqu&eacute;rir une propri&eacute;t&eacute;&nbsp;: la d&eacute;nomm&eacute;e &ldquo;usucapion ou <em>usucapio<\/em>&rdquo; du bien.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">Usucapion est un terme juridique informel utilis&eacute; pour d&eacute;signer la prescription acquisitive, qui est un moyen l&eacute;gal d&rsquo;acqu&eacute;rir la propri&eacute;t&eacute; par la possession d&rsquo;un bien, en tant que propri&eacute;taire et pendant les d&eacute;lais fix&eacute;s par la loi. Il s&rsquo;agit essentiellement de la possibilit&eacute; d&rsquo;acqu&eacute;rir un bien mobilier ou immobilier, de le poss&eacute;der comme si on en &eacute;tait le propri&eacute;taire, de mani&egrave;re publique, de bonne foi et sans interruption, c&rsquo;est-&agrave;-dire que nul n&rsquo;ayant droit &agrave; lui ne discute de la possession pendant une certaine p&eacute;riode de temps.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">L&rsquo;usucapion peut &ecirc;tre ordinaire ou extraordinaire.<\/p>\n<p style=\"text-align: justify;\">L&rsquo;usucapion<strong> <span style=\"text-decoration: underline;\">ordinaire<\/span><\/strong> exige l&rsquo;existence de bonne foi et d&rsquo;un juste titre. La bonne foi consiste &agrave; croire que l&rsquo;on est vraiment le propri&eacute;taire du bien ou &agrave; ignorer qu&rsquo;il y a un vice qui invalide l&rsquo;acquisition du bien. Un juste titre est un document qui se consid&egrave;re suffisant pour transf&eacute;rer l&eacute;galement la propri&eacute;t&eacute;: un contrat de vente, une donation, une d&eacute;cision de justice, etc.<\/p>\n<p style=\"text-align: justify;\">Le temps qui doit s&rsquo;&eacute;couler pour pouvoir acqu&eacute;rir un bien immobilier par usucapion ordinaire est de 10 ans entre personnes pr&eacute;sentes et de 20 ans entre personnes absentes. Selon la loi, les personnes absentes sont celles qui r&eacute;sident &agrave; l&rsquo;&eacute;tranger ou en outre-mer.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">Contrairement &agrave; l&rsquo;usucapion<strong> <span style=\"text-decoration: underline;\">ordinaire<\/span><\/strong>, l&rsquo;usucapion extraordinaire n&rsquo;exige ni juste titre, c&rsquo;est-&agrave;-dire avoir un document justifiant l&eacute;galement la possession, ni bonne foi, c&rsquo;est-&agrave;-dire croire que l&rsquo;on est le propri&eacute;taire ou ignorer qu&rsquo;il y a un vice ou d&eacute;faut dans la transmission qui l&rsquo;invalide. Elle ne fait pas non plus de diff&eacute;rence entre personnes pr&eacute;sentes et absentes. Cependant, le d&eacute;lai qui doit s&rsquo;&eacute;couler augmente des 10 ou 20 ans jusqu&rsquo;&agrave; 30 ans.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">Finalement, le facteur important, tant pour l&rsquo;usucapion ordinaire comme pour l&rsquo;extraordinaire, est le temps et le fait que, pendant l&rsquo;&eacute;coulement de ce temps, la possession ne soit pas interrompue. Le&nbsp; Code civil &eacute;tablit que l&rsquo;interruption se produit lorsque le possesseur re&ccedil;oit une notification judiciaire &agrave; cet &eacute;gard (par exemple, qu&rsquo;un tiers qui se consid&egrave;re le propri&eacute;taire pr&eacute;sente un proc&egrave;s d&rsquo;expulsion, etc.).<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">La propri&eacute;t&eacute; du bien par l&rsquo;usucapion ne s&rsquo;acqui&egrave;re pas automatiquement&nbsp;; elle doit &ecirc;tre d&eacute;clar&eacute;e par un tribunal.
