Conseil juridique."},"content":{"rendered":"\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><em>R\u00c9SUM\u00c9 DE L\u2019ARTICLE<\/em><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><em><u>Quand peut-on contester un accord de la copropri\u00e9t\u00e9?<\/u><\/em><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><em>La LPH permet de contester les accords s\u2019ils sont contraires \u00e0 la loi ou aux statuts, pr\u00e9judiciables \u00e0 la copropri\u00e9t\u00e9 ou \u00e0 un propri\u00e9taire, ou adopt\u00e9s par abus de droit. Mais aussi, en cas de vices de forme, d\u2019absence de convocation ou de notification \u00e0 l\u2019assembl\u00e9e, d\u2019absence de quorum, de privation indue du droit de vote, etc.<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em><u>Types d\u2019accords et majorit\u00e9s<\/u><\/em><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><em>L\u2019approbation d\u2019un accord requiert diff\u00e9rentes majorit\u00e9s, selon la mati\u00e8re en question. Certains accords exigent l\u2019unanimit\u00e9 (modification du titre constitutif ou des statuts), d\u2019autres, n\u00e9cessitent une majorit\u00e9 qualifi\u00e9e (travaux d\u2019am\u00e9lioration ou interdiction de la location touristique). Il existe aussi des mati\u00e8res pour lesquelles une majorit\u00e9 simple suffit (accords ordinaires). Un accord sans majorit\u00e9 l\u00e9gale peut \u00eatre contest\u00e9.<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em><u>L\u00e9gitimation, d\u00e9lais et MASC\/MARL.<\/u><\/em><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Peuvent contester: les propri\u00e9taires ayant vot\u00e9 contre (et apparaissant indiqu\u00e9 dans le proc\u00e8s-verbal), les voisins absents, les propri\u00e9taires ind\u00fbment priv\u00e9s de leur droit de vote ou ceux qui se sont abstenus ou ont manifest\u00e9 leur d\u00e9saccord. Le d\u00e9lai g\u00e9n\u00e9ral est de 3 mois. Mais si l\u2019accord est contraire \u00e0 la loi ou aux statuts, le d\u00e9lai est d\u2019un an. Avant de saisir les tribunaux, il est obligatoire de tenter un MASC (MARL ou MARD en fran\u00e7ais&nbsp;: Mode Alternatif de R\u00e8glement de Litiges ou de Diff\u00e9rends).<\/em><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nous recevons fr\u00e9quemment dans notre cabinet des questions concernant la possibilit\u00e9 de contester un accord de copropri\u00e9t\u00e9. Dans l\u2019article de cette semaine, nous proposons un guide bref \u00e0 nos lecteurs sur la mani\u00e8re, le moment et dans quels cas il est possible de <a href=\"https:\/\/www.white-baos.com\/fr\/contestation-de-laccord-de-la-copropriete-la-convocation\/\">contester un accord approuv\u00e9 par la copropri\u00e9t\u00e9<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Quand peut-on contester un accord de copropri\u00e9t\u00e9 ?<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1960-10906\">loi sur la propri\u00e9t\u00e9 horizontale<\/a> permet de contester judiciairement les accords adopt\u00e9s par l\u2019Assembl\u00e9e dans certains cas:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">.- Lorsque l\u2019accord est contraire \u00e0 la loi ou aux statuts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">.- Si elle porte gravement atteinte aux int\u00e9r\u00eats de la copropri\u00e9t\u00e9 au profit d\u2019un ou de plusieurs propri\u00e9taires.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">.- Lorsqu\u2019elle cause un pr\u00e9judice grave \u00e0 un propri\u00e9taire qui n\u2019a pas l\u2019obligation juridique de le supporter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">.- Etc.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ces raisons peuvent d\u00e9couler tant de questions de fond que de vices de forme.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Types d\u2019accords et majorit\u00e9s requises.<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Tous les accords communautaires ne s\u2019adoptent pas avec la m\u00eame majorit\u00e9. La loi distingue les accords qui requi\u00e8rent l\u2019unanimit\u00e9 (par exemple, la modification du titre constitutif ou des statuts), les majorit\u00e9s qualifi\u00e9es (travaux d\u2019am\u00e9lioration, interdiction, de la <a href=\"https:\/\/www.white-baos.com\/fr\/location-touristique-a-la-communaute-valencienne-espagne\/\">location touristique<\/a>, etc.) ou la majorit\u00e9 simple (les accords ordinaires du quotidien).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ceci est essentiel, car un accord adopt\u00e9 sans respecter la majorit\u00e9 l\u00e9galement requise peut \u00eatre contest\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Qui peut contester un accord de copropri\u00e9t\u00e9 ? D\u00e9lai.<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En g\u00e9n\u00e9ral, sont habilit\u00e9s \u00e0 contester les accords :<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">.- Les propri\u00e9taires ayant vot\u00e9 contre et l\u2019ayant fait consigner au proc\u00e8s-verbal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">.- Les voisins absents, et ceux qui ont \u00e9t\u00e9 ind\u00fbment priv\u00e9s du droit de vote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">.- Et les propri\u00e9taires ayant manifest\u00e9 explicitement leur d\u00e9saccord ou r\u00e9serv\u00e9 leur position face \u00e0 une r\u00e9solution en s\u2019abstenant lors de l\u2019Assembl\u00e9e.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De mani\u00e8re g\u00e9n\u00e9rale, il faut \u00eatre \u00e0 jour dans le <a href=\"https:\/\/www.white-baos.com\/fr\/dettes-de-lheritage-impot-sur-les-successions-en-espagne\/\">paiement des dettes<\/a> envers la communaut\u00e9 ou avoir consign\u00e9 leur montant, bien qu\u2019il existe des exceptions. Le d\u00e9lai de prescription g\u00e9n\u00e9ral pour contester des accords est de 3 mois. Mais si l\u2019accord est contraire \u00e0 la loi ou aux statuts, le d\u00e9lai est port\u00e9 \u00e0 1 an et il commence \u00e0 compter le jour de l\u2019Assembl\u00e9e (pour les assistants) ou \u00e0 la date de notification du proc\u00e8s-verbal (pour les absents).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans des cas exceptionnels, la jurisprudence admet que certains accords ne soient pas soumis au d\u00e9lai de prescription ordinaire. Il s\u2019agit des accords qui contreviennent gravement \u00e0 des r\u00e8gles imp\u00e9ratives ou interdites, \u00e0 l\u2019ordre public ou \u00e0 la morale, ou constitutifs de fraude de loi. Cependant, nous recommandons toujours de contester le plus t\u00f4t possible et dans les d\u00e9lais l\u00e9gaux.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Obligation du MASC avant de saisir les tribunaux.<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Depuis l\u2019entr\u00e9e en vigueur de la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2025-76\">loi organique 1\/2025<\/a>, avant de contester par voie judiciaire un accord, il est obligatoire de recourir \u00e0 un mode alternatif de r\u00e8glement des litiges ou des diff\u00e9rends &nbsp;(MASC). Cette tentative pr\u00e9alable de n\u00e9gociation\/m\u00e9diation est une condition d\u2019admission de la demande. \u00c0 savoir que si elle n\u2019est pas justifi\u00e9e, la demande sera irrecevable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Conclusions<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Il est possible de contester un accord de la copropri\u00e9t\u00e9 mais cela demande de le faire dans les d\u00e9lais et selon les exigences \u00e9tablies par la LPH.
