Cette semaine, nous abordons et nous analysons le principal imp\u00f4t pay\u00e9 lors de l\u2019acquisition d\u2019une propri\u00e9t\u00e9\u00a0: l\u2019imp\u00f4t sur les transmissions patrimoniales<\/a>, avec le taux g\u00e9n\u00e9ral et les taux r\u00e9duits existants qui, selon les circonstances, peuvent vous \u00eatre appliqu\u00e9s et repr\u00e9senter des \u00e9conomies importantes.<\/p>\n\n\n\n

Imp\u00f4t sur les Transmissions Patrimoniales on\u00e9reuses.<\/u><\/strong><\/h2>\n\n\n\n

L\u2019ITP s\u2019applique g\u00e9n\u00e9ralement aux ventes de biens immobiliers d\u2019occasion entre particuliers. C\u2019est-\u00e0-dire, les maisons, les d\u00e9barras, les garages, etc. qui ne sont de nouvelles construction. Il s\u2019agit d\u2019un imp\u00f4t d\u2019\u00c9tat bien qu\u2019il soit actuellement transf\u00e9r\u00e9 aux diff\u00e9rents gouvernements r\u00e9gionaux espagnols qui s\u2019occupent de sa gestion, son inspection et sa collecte.<\/p>\n\n\n\n

L\u2019ITP \u00e0 la Communaut\u00e9 Valencienne : o\u00f9, quand et combien paie-t-on ?<\/u><\/strong><\/h2>\n\n\n\n

Comme nous venons de dire, il faut payer l\u2019ITP lors de l\u2019acquisition d\u2019un bien d\u2019occasion. Cet imp\u00f4t est calcul\u00e9 sur la valeur de cession d\u00e9clar\u00e9 dans l\u2019acte, \u00e0 une exception pr\u00e8s : que cette valeur soit inf\u00e9rieure \u00e0 la Valeur de R\u00e9f\u00e9rence<\/em><\/a> <\/em>fix\u00e9e par la Direction G\u00e9n\u00e9rale du Cadastre. L\u2019imposition sera toujours pay\u00e9e sur la valeur la plus \u00e9lev\u00e9e des deux (sur la valeur de transmission ou la valeur de r\u00e9f\u00e9rence).<\/p>\n\n\n\n

Le d\u00e9lai de paiement de l\u2019imp\u00f4t \u00e0 la Communaut\u00e9 Valencienne est de 30 jours depuis la signature de l\u2019acte authentique de vente.  L\u2019autoliquidation (le formulaire 600) se pr\u00e9sente aupr\u00e8s du fisc r\u00e9gional (Agencia Tributaria Valencia<\/em>).<\/p>\n\n\n\n

Le taux g\u00e9n\u00e9ral applicable \u00e0 l\u2019imp\u00f4t.<\/u><\/strong><\/h2>\n\n\n\n

Comme indiqu\u00e9, ce sont les administrations r\u00e9gionales espagnoles qui ont le pouvoir de fixer le taux applicable. \u00c0 la Communaut\u00e9 Valencienne<\/a>, le taux g\u00e9n\u00e9ral est de 10%, mais il y a une s\u00e9rie d\u2019exceptions qu\u2019il convient de conna\u00eetre et qui peuvent repr\u00e9senter d\u2019importantes \u00e9conomies pour vous, selon le cas.<\/p>\n\n\n\n

Les taux r\u00e9duits lors de l\u2019achat d\u2019une propri\u00e9t\u00e9 dans la r\u00e9gion de Valencia.<\/u><\/strong><\/h2>\n\n\n\n

\u00c0 la Communaut\u00e9 Valencienne, l\u2019ITP est r\u00e9glement\u00e9 dans la loi 13\/1997, qui pr\u00e9voit un taux r\u00e9duit dans les cas suivants :<\/p>\n\n\n\n

Taux r\u00e9duit de 8%<\/u><\/em><\/strong> <\/h3>\n\n\n\n

Pour les logements de plus de 180 000 \u20ac, s\u2019ils sont de protection publique<\/a> sous le r\u00e9gime g\u00e9n\u00e9ral ou si l\u2019acheteur a moins de 35 ans. Dans les deux cas lorsque le logement va devenir la  premi\u00e8re r\u00e9sidence habituelle de l\u2019acheteur.<\/p>\n\n\n\n

Taux r\u00e9duit de 6%<\/u><\/em><\/strong> <\/strong><\/h3>\n\n\n\n

Pour les logements de moins de 180 000 \u20ac s\u2019ils sont de protection officielle ou si l\u2019acheteur a moins de 35 ans et dans les deux cas si le logement va devenir la r\u00e9sidence habituelle.<\/p>\n\n\n\n

Taux r\u00e9duit de 4%<\/u><\/em><\/strong> <\/strong><\/strong><\/h3>\n\n\n\n

Pour les logements de plus de 180 000 \u20ac s\u2019il va devenir la r\u00e9sidence habituelle et s\u2019il s\u2019agit de logements de protection officielle sous le r\u00e9gime sp\u00e9cial. \u00c9galement lorsque l\u2019acheteur pr\u00e9sente un <\/strong>handicap<\/a> sup\u00e9rieur \u00e0 65% (physique ou sensoriel) ou \u00e0 33% (mental). Et aussi, et entre autres, si l\u2019acheteur est une femme victime de violences de genre ou si c\u2019est une famille nombreuse.<\/strong><\/strong><\/p>\n\n\n\n

Taux r\u00e9duit de 3%<\/u><\/em><\/strong><\/u><\/em><\/h3>\n\n\n\n

Pour les logements de protection officielle sous le r\u00e9gime sp\u00e9cial<\/strong> de moins de 180 000 \u20ac, ou ceux dont l\u2019acqu\u00e9reur pr\u00e9sente les handicaps susmentionn\u00e9s, et qui sera la r\u00e9sidence habituelle.<\/p>\n\n\n\n
