Nous avons expliqu\u00e9 il y a quelques semaines les principales <a href=\"https:\/\/www.white-baos.com\/fr\/achat-de-maison-sur-plan-en-espagne-assistance-juridique-de-quoi-devons-nous-tenir-compte\/\">garanties l\u00e9gales et les droits<\/a> qui assistent tout acheteur dans un achat sur plan\u00a0: le compte sp\u00e9cial du promoteur, le renforcement des sommes, les documents que le promoteur doit fournir avant de signer le contrat, etc. Cette semaine, comme suite de cet article, nous analysons la remise des cl\u00e9s et les documents que le promoteur doit fournir \u00e0 ce moment-l\u00e0.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Remise des cl\u00e9s et signature de l\u2019acte authentique devant notaire.<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Une fois la construction de la propri\u00e9t\u00e9 achev\u00e9e, l\u2019acheteur et le promoteur&nbsp; compl\u00e8teront l\u2019op\u00e9ration en remettant les cl\u00e9s&nbsp; et en signant l\u2019acte authentique devant notaire. Quand estime-t-on que la propri\u00e9t\u00e9 est termin\u00e9e et qu\u2019elle est pr\u00eate \u00e0 \u00eatre livr\u00e9e? Le <a href=\"https:\/\/www.white-baos.com\/fr\/accords-initiaux-de-vente-espagne\/\">contrat priv\u00e9<\/a> de vente \u00e9tablit tr\u00e8s pr\u00e9cis\u00e9ment ce moment. G\u00e9n\u00e9ralement on estime&nbsp; qu\u2019elle est achev\u00e9e et en \u00e9tat d\u2019\u00eatre l\u00e9galement re\u00e7ue par l\u2019acheteur lors de l\u2019obtention de&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Certificat de fin des travaux.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Il doit \u00eatre souscrit par le <a href=\"https:\/\/www.white-baos.com\/fr\/quel-est-le-delai-pour-pouvoir-reclamer-au-constructeur-architectes-etc-pour-un-probleme-dans-la-structure-et-les-fondations-de-ma-maison\/\">technicien charg\u00e9 des travaux<\/a> &nbsp;et d\u00fbment vis\u00e9 par le Coll\u00e8ge des architectes. Ce document certifie que les travaux sont termin\u00e9s et conformes aux exigences l\u00e9gales applicables.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Permis de premi\u00e8re occupation\/D\u00e9claration responsable.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">C\u2019est le <a href=\"https:\/\/www.white-baos.com\/fr\/declaration-responsable-de-seconde-occupation-problemes-courants\/\">document administratif<\/a> qui permet l\u2019occupation du logement et dont l\u2019objectif est de certifier que la propri\u00e9t\u00e9 a \u00e9t\u00e9 construite conform\u00e9ment au projet et aux conditions selon lesquelles la municipalit\u00e9 a accord\u00e9 le permis de construire.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Acte de partage de nouvelle construction et de propri\u00e9t\u00e9 horizontale.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ce document \u00e9tablit quels \u00e9l\u00e9ments sont communs et lesquels&nbsp; sont priv\u00e9s, la mani\u00e8re dont les logements sont organis\u00e9s au sein de la copropri\u00e9t\u00e9, la quote-part de chaque propri\u00e9taire par rapport \u00e0 la totalit\u00e9 de l\u2019immeuble, etc.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans tous les cas, il est aussi possible (et m\u00eame fortement conseill\u00e9) de conditionner la livraison de la propri\u00e9t\u00e9 \u00e0 d\u2019autres questions, comme par exemple l\u2019ach\u00e8vement des \u00e9l\u00e9ments communs&nbsp;: la piscine, la salle et les terrains de sport, etc.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Documentation \u00e0 exiger au promoteur lors de la remise des cl\u00e9s.<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En plus de la remise des cl\u00e9s, chez <a href=\"https:\/\/www.white-baos.com\/fr\/identification-des-moyens-de-paiement-en-espagne\/\">le notaire<\/a>, le promoteur est tenu de remettre au consommateur une s\u00e9rie de documents, de mani\u00e8re \u00e0 ce que l\u2019acheteur puisse occuper le bien avec toutes les garanties. Parmi ces documents, les plus importants sont:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.white-baos.com\/fr\/acheter-et-vendre-une-propriete-immobiliere-en-espagne-le-certificat-de-performance-energetique-est-il-toujours-necessaire\/\">&#8211; Le diagnostic de performance \u00e9nerg\u00e9tique du logement.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Consignes d\u2019utilisation et d\u2019entretien de l\u2019installation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Certificat d\u2019installation de gaz, inspection initiale et mise en service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Mesures de s\u00e9curit\u00e9 incendie de l\u2019immeuble, ainsi que les consignes d\u2019\u00e9vacuation en cas d\u2019urgence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Les statuts de la copropri\u00e9t\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Garante de tous les \u00e9lectrom\u00e9nagers, d\u00fbment timbr\u00e9e par les fabricants.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Bulletins d\u2019installation d\u2019\u00e9lectricit\u00e9 et d\u2019eau potable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Si le logement est une <em>VPO<\/em> (<a href=\"https:\/\/www.white-baos.com\/fr\/vendre-un-logement-conventionne-communaute-valencienne\/\">logement conventionn\u00e9<\/a>), sa carte de qualification finale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Comme indiqu\u00e9 ci-dessus, le permis d\u2019occupation ou la d\u00e9claration responsable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Etc.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Conclusion<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Comme dans tout achat, la remise des cl\u00e9s et la signature de l\u2019acte authentique devant notaire est un moment crucial.
