Dans l\u2019article de cette semaine, nous analysons la <a href=\"https:\/\/www.white-baos.com\/fr\/comment-acheter-un-bien-immobilier-sans-argent-ni-hypotheque-la-condition-resolutoire-en-droit-espagnol\/\">condition r\u00e9solutoire<\/a>,&nbsp; sa r\u00e9glementation et ses principales caract\u00e9ristiques. Il s\u2019agit d\u2019une excellente alternative au&nbsp; financement lors de l\u2019achat d\u2019une propri\u00e9t\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Achats et ventes de biens immobiliers dans la l\u00e9gislation espagnole.<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le Code civil d\u00e9finit le contrat de vente dans son art. 1445 comme la transaction juridique dans laquelle \u00ab&nbsp;<em>une personne<\/em> <em>s\u2019oblige \u00e0 livrer une certaine chose, et une autre \u00e0 en payer un certain prix&nbsp;\u00bb<\/em>. Lorsque l\u2019acheteur ne dispose pas des fonds n\u00e9cessaires, il recourt normalement \u00e0 des formules de financement comme le <a href=\"https:\/\/www.white-baos.com\/fr\/reclamer-les-frais-douverture\/\">pr\u00eat hypoth\u00e9caire.<\/a> Mais qu\u2019en est-il s\u2019il n\u2019est pas possible d\u2019acc\u00e9der \u00e0 cet emprunt ? Existe-t-il une alternative ?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>La condition r\u00e9solutoire dans le syst\u00e8me espagnol.<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La condition r\u00e9solutoire est r\u00e9glement\u00e9e dans les articles 11 de la Loi Hypoth\u00e9caire, art. 59 de son r\u00e8glement et dans l\u2019art. 1504 du <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1889-4763\" target=\"_blank\" rel=\"noreferrer noopener\">Code civil<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Voici les deux fonctions principales de la condition r\u00e9solutoire:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>D\u2019une part, elle permet \u00e0 l\u2019acheteur d\u2019acqu\u00e9rir la possession et la propri\u00e9t\u00e9 d\u2019un bien immobilier m\u00eame s\u2019il ne dispose pas \u00e0 ce moment-l\u00e0 des fonds n\u00e9cessaires pour en payer le prix.<\/li>\n\n\n\n<li>De l\u2019autre, elle constitue une garantie pour le vendeur, qui pourra r\u00e9soudre l\u2019achat et r\u00e9cup\u00e9rer la propri\u00e9t\u00e9 vendue si l\u2019acheteur ne paie pas la totalit\u00e9 du prix convenu dans les d\u00e9lais accord\u00e9s.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Inscription aupr\u00e8s du registre de la propri\u00e9t\u00e9&nbsp;: v\u00e9ritable garantie.<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Pour que la condition r\u00e9solutoire soit une v\u00e9ritable garantie (pour qu\u2019elle reste li\u00e9e au bien), elle doit s\u2019inscrire aupr\u00e8s du <a href=\"https:\/\/www.white-baos.com\/fr\/premiere-inscription-dune-propriete\/\">registre de la propri\u00e9t\u00e9<\/a><a><\/a><a><\/a>, sinon&nbsp; le vendeur ne serait responsable du paiement diff\u00e9r\u00e9 qu\u2019avec son patrimoine. De plus, l\u2019inscription au registre foncier produira tous ses effets \u00e0 l\u2019\u00e9gard des tiers et elle privil\u00e9giera&nbsp; le paiement face \u00e0 d\u2019autres charges ou embargos qui puissent survenir. Voil\u00e0 pourquoi il est fortement conseill\u00e9 de conditionner la vente de la condition r\u00e9solutoire \u00e0 l\u2019inscription aupr\u00e8s du registre de la propri\u00e9t\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Que se passe-t-il si l\u2019acheteur ne respecte pas les obligations de paiement&nbsp; convenues ?<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En cas de non-respect de la part de l\u2019acheteur, le vendeur pourra r\u00e9cup\u00e9rer le bien immobilier et normalement l\u2019acheteur perd \u00e9galement toutes les sommes vers\u00e9es au vendeur jusque-l\u00e0. Il est aussi possible de fixer une p\u00e9nalit\u00e9 pour les dommages caus\u00e9s au vendeur. Pour r\u00e9soudre de mani\u00e8re efficace la vente, il faudra <a href=\"https:\/\/www.white-baos.com\/fr\/resiliation-et-fin-du-contrat-de-vente-non-paiement-du-prix-par-lacheteur-mise-en-demeure-notariee-actions-en-justice-et-conseil-juridique\/\">que le vendeur exige un paiement notari\u00e9<\/a> ou une mise en demeure judiciaire.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Et si l\u2019acheteur respecte ce qui a \u00e9t\u00e9 convenu ? Comment annule-t-on la condition r\u00e9solutoire ?<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Une fois que l\u2019acheteur a pay\u00e9 la totalit\u00e9 du prix, il convient de r\u00e9silier la condition r\u00e9solutoire pour que le bien soit libre de charges. Pour cela, les deux parties (acheteur et vendeur) d\u00e9clarent devant notaire que le montant diff\u00e9r\u00e9 a \u00e9t\u00e9 pay\u00e9. Ce nouvel acte notari\u00e9 sera tax\u00e9 par l\u2019AJD \u00e0 1,5% (\u00e0 la <a href=\"https:\/\/www.white-baos.com\/fr\/impot-sur-les-successions-et-les-donations-a-la-communaute-valencienne\/\">Communaut\u00e9 Valencienne<\/a><a><\/a><a><\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cependant, le moyen d\u2019\u00e9viter cette d\u00e9pense est de convenir que la condition r\u00e9solutoire soit annul\u00e9e d\u2019embl\u00e9e par l\u2019\u00e9coulement d\u2019un d\u00e9lai d\u00e9termin\u00e9 \u00e0 compter de l\u2019expiration de l\u2019obligation de paiement.
