La r\u00e9glementation espagnole oblige les promoteurs qui vendent des biens immobiliers sur plans \u00e0 garantir les les acomptes fournis par les acheteurs \u2013 consommateurs; au moyen d\u2019une garantie bancaire ou d\u2019une assurance. Par cons\u00e9quent, si l\u2019on v\u00e9rifie correctement et que l\u2019on ach\u00e8te avec l\u2019assistance juridique ad\u00e9quate, en th\u00e9orie l\u2019Espagne est l\u2019un des pays les plus s\u00fbrs pour acheter sur plans un bien immobilier pas encore construit. Mais ce n\u2019est que la th\u00e9orie, car dans la pratique les abus des promoteurs ont \u00e9t\u00e9 nombreux. C\u2019est pourquoi il est fondamental d\u2019effectuer une \u00abdue diligence\u00bb<\/em> l\u00e9gale ad\u00e9quate avant de convenir d\u2019un achat-vente de ce genre.<\/p>\n\n\n\n

De toute fa\u00e7on, la r\u00e9glementation espagnole, qui \u00e9tait tr\u00e8s protectrice des consommateurs, a \u00e9t\u00e9 modifi\u00e9e r\u00e9cemment, nous entendons contre les int\u00e9r\u00eats du consommateur, dans la Loi 20\/2015 qui affecte la Loi 38\/1999, d\u2019Am\u00e9nagement de la Construction.<\/strong><\/p>\n\n\n\n

Changements de r\u00e9glementation<\/h2>\n\n\n\n

Des changements de r\u00e9glementation, nous en soulignons deux qui ne nous plaisent pas, car ils limitent et affectent les droits qu\u2019avaient les consommateurs\u00a0:<\/p>\n\n\n\n

1) Maintenant il est dit que les promoteurs qui vendent sur plans devront garantir les acomptes fournis, depuis le moment de l\u2019obtention du permis de construire.<\/em><\/strong> Par cons\u00e9quent, cela semble exclure l\u2019obligation d\u2019avoir les quantit\u00e9s vers\u00e9es d\u2019assur\u00e9es, avant d\u2019avoir obtenu le permis de construire. Ce qui n\u2019arrivait pas avec la r\u00e9daction pr\u00e9c\u00e9dente.<\/p>\n\n\n\n

Par cons\u00e9quent, maintenant il est absolument d\u00e9conseill\u00e9 de payer de l\u2019argent, et d\u2019acheter toute propri\u00e9t\u00e9 sur plans, sauf s\u2019il existe un permis de construire, ou que l\u2019on donne une garantie suffisante \u00e0 l\u2019acheteur-consommateur.<\/p>\n\n\n\n

2) On inclut maintenant une nouvelle limitation dans le temps, en signalant que pass\u00e9 un d\u00e9lai de deux ans, \u00e0 compter depuis le non-respect de la part du promoteur de l\u2019obligation garantie, c\u2019est-\u00e0-dire depuis la date pr\u00e9vue de remise de la propri\u00e9t\u00e9, si l\u2019acheteur-consommateur ne demande pas la rupture du contrat et le remboursement des acomptes, la garantie bancaire expirera.<\/p>\n\n\n\n

On signale que ces changements entreront en vigueur le 1er<\/sup> janvier 2016.<\/p>\n\n\n\n

Par cons\u00e9quent, ceux qui ont achet\u00e9 avant cette date ne seront pas touch\u00e9s par ce changement de r\u00e9glementation. Et ceux qui ach\u00e8tent sur plans \u00e0 partir de janvier 2016 devront faire preuve d\u2019une extr\u00eame prudence et faire les v\u00e9rifications l\u00e9gales pertinentes.<\/strong><\/p>\n\n\n\n
