LAS CAUSAS DE DESHEREDACI\u00d3N. \u00bfC\u00d3MO IMPUGNAR UN TESTAMENTO ESPA\u00d1OL?"},"content":{"rendered":"<div style=\"font-family: Arial, Verdana; font-size: 10pt; font-style: normal; font-variant: normal; line-height: normal; text-align: justify;\"><span style=\"font-size: small;\"><strong>CONSULTA:<\/strong><\/span><\/p>\n<div style=\"text-align: justify;\"><strong>Mi madre ha fallecido dejando un testamento, redactado seg&uacute;n ley espa&ntilde;ola, en este testamento me deshereda a m&iacute; y deja todo a mi hermana como &uacute;nica heredera. &iquest; Puedo impugnar el testamento? &iquest; Qu&eacute; debo hacer, puedo reclamar legalmente? <\/strong><\/div>\n<div style=\"text-align: justify;\"><\/p>\n<div style=\"text-align: justify;\"><span style=\"font-family: Arial, Verdana; font-size: small;\">Estimada lectora,<\/span><\/p>\n<div style=\"text-align: justify;\"><span style=\"font-family: Arial, Verdana; font-size: small;\">La desheredaci&oacute;n en Espa&ntilde;a se regula principalmente en los art&iacute;culos 848 a 857 del C&oacute;digo Civil espa&ntilde;ol.<\/span><\/p>\n<div style=\"text-align: justify;\"><span style=\"font-family: Arial, Verdana; font-size: small;\">En derecho espa&ntilde;ol, s&oacute;lo se puede desheredar por las causas que est&aacute;n previstas en la ley, y en el caso de los hijos y descendientes, estas causas son principalmente:<\/span><\/p>\n<div style=\"text-align: justify;\"><\/p>\n<div style=\"text-align: justify;\">1.&ordf; Haber negado, sin motivo leg&iacute;timo, los alimentos al padre o ascendiente que le deshereda.<\/div>\n<div style=\"text-align: justify;\">2.&ordf; Haberle maltratado de obra o injuriado ( insultado, faltado al respeto) gravemente de palabra.<\/div>\n<div style=\"text-align: justify;\"><\/p>\n<div style=\"text-align: justify;\">El c&oacute;digo civil prev&eacute; distintas causas para los ascendientes ( padres, abuelos), descendientes ( hijos, nietos) y c&oacute;nyuge.<\/div>\n<div style=\"text-align: justify;\"><span style=\"font-family: Arial, Verdana; font-size: small;\">Seg&uacute;n la ley espa&ntilde;ola, solo ser&aacute; v&aacute;lida la desheredaci&oacute;n si se ha realizado en el testamento y expresando causa justa.<\/span><\/p>\n<div style=\"text-align: justify;\"><span style=\"font-family: Arial, Verdana; font-size: small;\">Si usted entiende que la desheredaci&oacute;n no es justa, y que la causa de desheredaci&oacute;n no es cierta, puede impugnar el testamento, y ser&aacute;n los herederos los que deban probar la veracidad de la causa de desheredaci&oacute;n.<\/span><\/p>\n<div style=\"text-align: justify;\"><span style=\"font-family: Arial, Verdana; font-size: small;\"><br \/><\/span><\/p>\n<div style=\"text-align: justify;\"><span style=\"font-family: Arial, Verdana; font-size: small;\">As&iacute;, si usted impugna el testamento con &eacute;xito, se anular&aacute; la instituci&oacute;n de herederos y usted tendr&aacute; derecho a recibir la legitima ( articulo 851 de C&oacute;digo Civil).<\/span><\/p>\n<div style=\"text-align: justify;\"><span style=\"font-family: Arial, Verdana; font-size: small;\">Debe saber, que si puede probar que hubo reconciliaci&oacute;n posterior con el testador, quedar&aacute; sin efecto la desheredaci&oacute;n ya realizada.
