CONSULTA:<\/strong><\/span><\/p>\n
Mi madre ha fallecido dejando un testamento, redactado según ley española, en este testamento me deshereda a mí y deja todo a mi hermana como única heredera. ¿ Puedo impugnar el testamento? ¿ Qué debo hacer, puedo reclamar legalmente? <\/strong><\/div>\n
<\/p>\n
Estimada lectora,<\/span><\/p>\n
La desheredación en España se regula principalmente en los artículos 848 a 857 del Código Civil español.<\/span><\/p>\n
En derecho español, sólo se puede desheredar por las causas que están previstas en la ley, y en el caso de los hijos y descendientes, estas causas son principalmente:<\/span><\/p>\n
<\/p>\n
1.ª Haber negado, sin motivo legítimo, los alimentos al padre o ascendiente que le deshereda.<\/div>\n
2.ª Haberle maltratado de obra o injuriado ( insultado, faltado al respeto) gravemente de palabra.<\/div>\n
<\/p>\n
El código civil prevé distintas causas para los ascendientes ( padres, abuelos), descendientes ( hijos, nietos) y cónyuge.<\/div>\n
Según la ley española, solo será válida la desheredación si se ha realizado en el testamento y expresando causa justa.<\/span><\/p>\n
Si usted entiende que la desheredación no es justa, y que la causa de desheredación no es cierta, puede impugnar el testamento, y serán los herederos los que deban probar la veracidad de la causa de desheredación.<\/span><\/p>\n

<\/span><\/p>\n
Así, si usted impugna el testamento con éxito, se anulará la institución de herederos y usted tendrá derecho a recibir la legitima ( articulo 851 de Código Civil).<\/span><\/p>\n
Debe saber, que si puede probar que hubo reconciliación posterior con el testador, quedará sin efecto la desheredación ya realizada. En este punto, recordar que es deseable si hay reconciliación, que se plasme de forma solemne y si es posible en documento público ante notario.<\/span><\/p>\n
<\/p>\n
Finalmente, sepa que según el derecho español, y en el peor de los casos, si se probase que la desheredación es justa, el artículo 857 del código civil dice que:<\/div>\n
“Los hijos o descendientes del desheredado ocuparán su lugar y conservarán los derechos de herederos forzosos respecto a la legítima.<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
