{"id":6389,"date":"2010-10-24T12:10:00","date_gmt":"2010-10-24T12:10:00","guid":{"rendered":"https:\/\/www.white-baos.com\/prenuptial-agreement-in-spain-capitulaciones-matrimoniales-and-the-nuptial-letter-marriage-between-spanish-and-english-applicable-law\/"},"modified":"2024-07-09T18:24:42","modified_gmt":"2024-07-09T16:24:42","slug":"prenuptial-agreement-in-spain-capitulaciones-matrimoniales-and-the-nuptial-letter-marriage-between-spanish-and-english-applicable-law","status":"publish","type":"post","link":"https:\/\/www.white-baos.com\/en\/prenuptial-agreement-in-spain-capitulaciones-matrimoniales-and-the-nuptial-letter-marriage-between-spanish-and-english-applicable-law\/","title":{"rendered":"Prenuptial agreement in Spain, capitulaciones matrimoniales and the nuptial letter: marriage between Spanish and English, applicable law"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Prenuptial agreement and Valencian Law<\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p>An example of the significance of this Law, Prenuptial agreement, is found at Article 4, which states that the Valencian Matrimonial Regime will be established by the spouses with total and complete freedom in the nuptial agreement letter (capitulaciones matrimoniales) without further limitations.<\/p>\n\n\n\n<p>If a prenuptial agreement letter (capitulationes matrimoniales) is not signed then the \u201c<a href=\"https:\/\/www.white-baos.com\/en\/?s=economic+separation+regime&amp;submit=Search\">economic separation regime<\/a>\u201d will apply, \u2013 according to this regime the property and assets of each spouse will always belong to that spouse. Both spouses will own their own property and any assets acquired during the marriage will not be divided between them. This is the opposite of the previous regime of marital property \u2013community of assets (bienes gananciales).<\/p>\n\n\n\n<p>This economic separation regime is not the same as the English system where, under English law, a couple that has been married for many years would normally see all assets divided equally between the parties, regardless of who acquired them.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2007-8279\">In Article 25 of the said Law 10\/2007<\/a> it is emphasized that a prenuptial agreement can establish the economic system of marriage and any other agreements concerning property or other matters between the spouses or for themselves, their children already born and any future children, and will be effective during the marriage or after its dissolution (divorce\/separation), with no restrictions other than those set out in the Act.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">To be signed in front of a notary.<\/h3>\n\n\n\n<p>Similar to an agreement drawn up by a couple in the event of a divorce by consent, we understand that this freedom to agree is always subject to a Court\u2019s approval since it must take into account issues such as the interests of minor children, moral, etc.. A prenuptial agreement should be granted in writing before a <a href=\"https:\/\/www.white-baos.com\/en\/civil-marriage-in-spain-foreigners\/\">public notary<\/a> in order to avoid problems and to give the agreement higher \u2018formality\u2019 since the intervention of the notary can also be seen as a guarantee that the parties have reached agreement freely and of their own will<\/p>\n\n\n\n<p>English law also provides for the possibility of a prenuptial agreement being recognized, although it is true that there is some doubt as to the requirements these agreements must fulfill. Factors to be taken into consideration by an English Court such as whether independent legal advice was received before signing, a report specifying the assets belonging to each spouse before marriage and finally the agreement has to be signed some time before the marriage takes place.<\/p>\n\n\n\n<p>Therefore, in your case, being the circumstance mentioned we understand that the law to be applied is the Law for Valencian Matrimonial Regime (<a href=\"https:\/\/www.white-baos.com\/en\/the-importance-of-knowing-your-matrimonial-property-regime-post-and-pre-nuptial-agreements-in-spain\/\">Matrimonial Property<\/a>).
