1.- Life insurance does not form part of the estate.<\/u><\/em><\/em><\/p>\n\n\n\n

The proceeds of a life insurance policy are paid directly to the beneficiaries named in the policy. They do not form part of the deceased’s estate and are not subject to the rules governing the distribution of an inheritance. This has significant legal consequences that are important to understand.<\/em><\/p>\n\n\n\n

2.- Beneficiaries and forced heirs. <\/u><\/em><\/em><\/p>\n\n\n\n

The fact that life insurance falls outside the estate does not mean it is entirely unrelated to the calculation of forced heirs’ legitimate shares. In certain circumstances, forced heirs could bring a claim if they consider the policy has been used to reduce their entitlement.<\/em><\/p>\n\n\n\n

3.- Taxation of life insurance.<\/u><\/em><\/p>\n\n\n\n

Life insurance proceeds are subject to Inheritance and Gift Tax, but separately from the rest of the estate. The applicable rules vary by region, and specific reductions may apply depending on the relationship between the beneficiary and the deceased.<\/em><\/p>\n\n\n\n

When a person passes away having held a life insurance policy, their loved ones are often faced with a situation that raises many questions. Does the insurance form part of the estate? Can forced heirs<\/a> make a claim against it? How is it taxed? In this week’s article, we analyse everything you need to know about life insurance and inheritance in Spain.<\/p>\n\n\n\n

Life insurance does not form part of the estate.<\/u><\/strong><\/h2>\n\n\n\n

This is the general rule and the essential starting point. The life insurance payout does not form part of the deceased’s estate. It is delivered directly to the beneficiaries named in the policy, regardless of what the will may say. This is established by Article 88 of Law 50\/1980 on Insurance Contracts.<\/a><\/p>\n\n\n\n

This means that the designated beneficiary receives the insurance capital outside of the succession process. They do not need to wait for the acceptance of the inheritance. They do not share that capital with the other heirs. And, in principle (and save for very specific circumstances), it is not subject to the debts of the deceased.<\/p>\n\n\n\n

Who can be named as a beneficiary?.<\/u><\/strong><\/h2>\n\n\n\n

The policyholder may freely designate any person as beneficiary. It does not have to be an heir. It may be a child, a partner, a friend, or even a legal entity. The beneficiary may also be changed at any time during the policyholder’s lifetime, unless they have expressly waived that right.<\/p>\n\n\n\n

If no beneficiary is designated, or if the designated beneficiary predeceases the insured, the payout will be made to the heirs<\/a> of the insured, in accordance with the Insurance Contract Law. Note, however, that this does not mean the capital becomes part of the estate like the rest of the assets. The heirs will receive it in their capacity as insurance beneficiaries.<\/p>\n\n\n\n

Life insurance and forced heirs.<\/u><\/strong><\/h2>\n\n\n\n

This is where the main controversy arises. Forced heirs (children, spouse, ascendants) are entitled to receive their legitimate share of the estate. However, since life insurance falls outside the estate, it does not directly factor into that calculation.<\/p>\n\n\n\n

The Spanish Civil Code<\/a> allows forced heirs to bring a claim if their legitimate share has been infringed. Spanish courts have held that, in some cases, a life insurance policy may be regarded as a concealed gift intended to reduce the heirs’ legitimate entitlement. The answer is not straightforward and will depend on the specific circumstances of each case. If you are considering designating a beneficiary, or if you believe your forced heir rights may have been affected, it is essential to seek expert legal advice.<\/p>\n\n\n\n

Taxation of life insurance.<\/u><\/strong><\/h2>\n\n\n\n

The insurance payout is subject to Inheritance Tax<\/a>, but separately from the rest of the estate. Each beneficiary declares and pays tax on the amount received independently. In the Valencian Community, as in other regions, specific reductions may apply depending on the relationship between the beneficiary and the deceased. It is important to file the tax return within the established deadline to avoid the accrual of interest.<\/p>\n\n\n\n
