The case involves <a href=\"https:\/\/www.white-baos.com\/en\/contest-a-will-in-spain-legal-experts\/\">contesting a will in Spain<\/a>, the interpretation of the European Regulation 650\/2012 and its implications for inheritance laws with an international component. Our clients\u2014the deceased\u2019s children\u2014were unjustly excluded from their father&#8217;s inheritance. The judge ultimately ruled in our client\u2019s favour and upheld their right as legitimate heirs. Below, we examine the details of this case.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>European Regulation 650\/2012: Determining the Applicable Law for Succession<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As we have explained in previous articles, the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:32012R0650&amp;from=SK\" target=\"_blank\" rel=\"noreferrer noopener\">European Regulation 650\/2012<\/a> outlines the rules governing applicable laws in inheritance cases. Particularly those with international connections. According to Article 21, the law governing the inheritance will be that of the deceased&#8217;s last habitual residence at the time of their death. This law applies to the entire estate, covering all the assets the deceased holds globally.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, this European Regulation allows individuals to expressly choose in their will, the law of their nationality to govern their estate. This flexibility accommodates individual circumstances and respects the deceased&#8217;s intentions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Case Details: Italy, United Kingdom, and Spain. An International Inheritance<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To provide context to our readers, it is important to note that both Italian and Spanish laws include &#8220;<a href=\"https:\/\/www.white-baos.com\/en\/challenge-and-contest-wills-and-acceptance-and-adjudication-of-inheritance-deeds-in-spain-forced-heirs-inheritances-of-foreigners-in-spain\/\">forced heirs<\/a>&#8220;. Certain close family members who are legally entitled to a reserved share of the estate. Under English law, however, testators have complete freedom to distribute assets as they wish, without this limitation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this case, the deceased, an Italian citizen who spent most of his professional life in the United Kingdom, retired to Spain. Despite having is habitual residence in Marbella, he granted a will stating he was resident in the UK and chose English <a href=\"https:\/\/www.white-baos.com\/en\/contest-and-challenge-a-spanish-will-application-of-spanish-law-to-an-expat-inheritance\/\">law to apply to his estate<\/a>, thereby excluding his children and naming his second wife as sole heir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Contesting a Will: Habitual Residence of the Deceased.<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The First Instance Court of Marbella has issued a judgment confirming, as requested in our claim, that:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">.- European Regulation 650\/2012 only allows the choice of national law in a will, not any other law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">.- The deceased\u2019s habitual residence was located, unquestionably, in Spain. As supported by evidence such as utility bills, vehicle mileage records, witness statements, and more.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">.- Therefore, the deceased\u2019s will and the <a href=\"https:\/\/www.white-baos.com\/en\/acceptance-of-the-inheritance-by-the-heir-in-spain-consequences-legal-advice\/\">inheritance deed<\/a> through which the widow inherited all the assets, are both to be declared null and void.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">.- The court has ordered the defendant to pay legal costs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Conclusions.<\/u><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">International inheritance cases can be particularly complex, underscoring the need for expert legal advice when drafting a will.
