Beratung"},"content":{"rendered":"<p style=\"text-align: justify;\">Louer une propri&eacute;t&eacute; espagnole &agrave; des touristes, en particulier par le biais de plates-formes&nbsp; internet et de sites comme Airbnb,&nbsp; HomeAway, Windu, etc. est un moyen tr&egrave;s int&eacute;ressant d&rsquo;obtenir des rendements pour notre propri&eacute;t&eacute; en Espagne, et tr&egrave;s souvent c&rsquo;est beaucoup plus rentable que la location traditionnelle.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\"><strong>Il faut respecter certaines formalit&eacute;s l&eacute;gales qui sont plus exigeantes que celles de la location normale (soumise &agrave; la loi des baux urbains) et le non-respect de la r&eacute;glementation de locations touristiques peut entra&icirc;ner, entre autres,&nbsp; le paiement de fortes contraventions.<\/strong><\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">&Agrave; la Communaut&eacute; Valencienne, les logements touristiques et leur location sont r&eacute;glement&eacute;s dans la Loi 15\/2018 du 7 juin, de la Generalitat, sur le tourisme, les loisirs et l&rsquo;hospitalit&eacute; et aussi dans le D&eacute;cret 92\/2009. En Espagne il existe plusieurs r&eacute;glementations en fonction de l&rsquo;emplacement de la propri&eacute;t&eacute;.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">Selon cette norme, les logements d&rsquo;usage touristique sont ceux qui sont c&eacute;d&eacute;s pour un prix de fa&ccedil;on habituelle dans des conditions de disponibilit&eacute; imm&eacute;diate et &agrave; des fins touristiques, de vacances ou de loisirs.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">La r&eacute;glementation parle aussi du principe de l&rsquo;unit&eacute; d&rsquo;exploitation&nbsp;: les diff&eacute;rentes unit&eacute;s d&rsquo;h&eacute;bergement touristique qui int&egrave;grent le b&acirc;timent ou une partie ind&eacute;pendante et homog&egrave;ne de celui-ci, doivent &ecirc;tre g&eacute;r&eacute;es par une seule soci&eacute;t&eacute; de gestion.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Unit&eacute; d&rsquo;h&eacute;bergement.<\/span><\/strong> La loi valencienne ne pr&eacute;voit pas, et donc en g&eacute;n&eacute;ral il n&rsquo;est pas permis, qu&rsquo;une propri&eacute;t&eacute; (maison, appartement, etc.) ne soit consacr&eacute;e &agrave; la location touristique que partiellement, qu&rsquo;elle soit lou&eacute;e par chambres, ni que le propri&eacute;taire y vive pendant qu&rsquo;il en tire un profit comme location touristique.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Documentation<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">La demande et la d&eacute;marche d&rsquo;enregistrement d&rsquo;une propri&eacute;t&eacute; comme meubl&eacute; touristique sont assez simples s&rsquo;il s&rsquo;agit d&rsquo;un seul logement, voire jusqu&rsquo;&agrave; 4. Si l&rsquo;intention est d&rsquo;enregistrer 5 logements ou plus, les conditions requises sont diff&eacute;rentes.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">En g&eacute;n&eacute;ral, si vous souhaitez enregistrer votre propri&eacute;t&eacute; en tant que meubl&eacute; de tourisme, vous devrez fournir certains documents:<\/p>\n<p style=\"text-align: justify;\">.-<span style=\"text-decoration: underline;\">Titre de propri&eacute;t&eacute;:<\/span> vous devez prouver que vous en &ecirc;tes le propri&eacute;taire en pr&eacute;sentant l&rsquo;acte de vente, l&rsquo;h&eacute;ritage, etc.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">.-Rapport de compatibilit&eacute; de la mairie<\/span>.&nbsp; Depuis l&rsquo;approbation du nouveau r&egrave;glement (2018) il est n&eacute;cessaire d&rsquo;obtenir un rapport de la mairie o&ugrave; se trouve le meubl&eacute; qui confirme que l&rsquo;activit&eacute; de location touristique de votre propri&eacute;t&eacute; est compatible ou possible selon l&rsquo;am&eacute;nagement et la r&eacute;glementation urbaine.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Permis d&rsquo;occupation&nbsp;<\/span><\/strong><strong>:<\/strong> Il sera aussi n&eacute;cessaire pour pouvoir inscrire la propri&eacute;t&eacute; aupr&egrave;s du registre de logements touristiques et ainsi pouvoir l&rsquo;exploiter l&eacute;galement.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Registre de voyageurs&nbsp;<\/span><\/strong><strong>:<\/strong> Conform&eacute;ment &agrave; la r&eacute;glementation en vigueur, vous &ecirc;tes oblig&eacute; de tenir un registre de voyageurs et de communiquer leur entr&eacute;e &agrave; la police ou &agrave; la garde civile, selon les cas.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Logements touristiques sur sol non urbanisable&nbsp;<\/span><\/strong><strong>: <\/strong>Si votre propri&eacute;t&eacute;
