


I am divorcing and wish to change my name to revert to my maiden name - is this possible in Spain?
It is perfectly legal for a UK citizen over the age of 16 to be known by whatever name they desire, provided they do not intend to defraud anyone by using the new name. 'Deed Poll' is no longer the correct term for changing one's name although this is how it is commonly known. The legal process is relatively straightforward, quick and inexpensive.
If you have always harboured a secret desire to be known as 'Sidney Harbour Bridge' or 'Eileen Dover' then help is at hand. There are many other more plausible reasons for wanting to change your name however such as:
a married woman who has taken her husband's surname and now wants to include her maiden name;
a woman who has separated from her husband may wish to be known by her maiden name before her divorce is finalised;
a person who has become known by a name other than their 'real' name (i.e. a nickname or stage name) may wish to become formally known by that name.
The Procedure
As with most legal issues there is a correct way of changing one's name and an alternative, less formal method. It goes without saying that the correct method pays for itself in the long run. Whilst it is sufficient to simply sign a Deed declaring that you have changed your name, this will not be acceptable to government bodies such as the Passport Office and DVLA or a bank. It is therefore advisable to sign a Statutory Declaration which will need to be sworn by the declarant before a practicing solicitor or other authorised person.
Tip for Employers
Many employers will nowadays carry out a search against a potential employee in order to check that person's past and look for any criminal convictions. A person who has changed their name may have done so however in order to hide any skeletons which would otherwise have been more easily detectable. For this reason it can pay to request sight of the person's birth certificate since this is extremely difficult to change, and may show another name to search against.
Who to Inform
It is essential to inform everyone that has your personal records once you have changed your name. The list of organisations to contact includes your bank, employer, utility companies, doctor, dentist - basically everyone you can think of.
